Judicial interpretation of marital breakdown

In the trial of divorce cases, the people's court shall grant or deny divorce on the basis of whether the feelings between husband and wife have actually broken down. To judge whether the feelings of husband and wife have really broken down, we should make a comprehensive analysis from the aspects of marriage foundation, marriage feelings, divorce reasons, the status quo of the relationship between husband and wife and whether there is a possibility of reconciliation. According to the relevant provisions of the Marriage Law and the practical experience of the trial, any of the following circumstances shall be regarded as the relationship between husband and wife has indeed broken down. If one party insists on divorce and the mediation fails, divorce may be granted by judgment according to law.

(1) One party suffers from a disease legally prohibited from marriage, or one party has a physical defect or other reasons can not have sex, and it is difficult to cure.

(3) Concealing mental illness before marriage, not being cured after marriage, or getting married knowing that the other party suffers from mental illness before marriage, or one party suffers from mental illness during the period of husband and wife living together, and is not cured for a long time.

(7) There is no possibility of reconciliation, or there is another year of separation after the people's court has ruled that divorce is not allowed, and each other does not perform marital obligations.
